Breath & Blood Tests in Temecula
Our Temecula Lawyers Explain What You Should Know
One of the most common ways to gather evidence against an individual in a DUI case is the breath test. In California, “implied consent” law states that if you have been lawfully arrested for suspected drunk driving, you are required to consent to a chemical test to determine your blood alcohol content (BAC). Refusal to submit can result in serious consequences.
There are two types of breath tests that can be administered during a DUI investigation:
Preliminary Alcohol Screening (PAS) Breath Test
This is usually a breath test administered with the use of a handheld breathalyzer on the side of the road and is administered before an arrest is made.
Evidentiary Breath Test
This is more official and is conducted after the arrest has been made. It is administered with the use of a desktop breathalyzer and usually back at the police station.
If you are over 21 years of age and are not on probation for a previous DUI, the PAS test is optional—although that is rarely explained by the police during the course of the investigation.
Understanding the Blood Test
Another form of BAC testing occurs in the form of a blood test. This is generally believed to be more reliable than the breath test; however, it is not a foolproof way of determining whether a driver is or is not intoxicated. There are ways that the results can be challenged, and our Temecula DUI defense attorneys can help. Contact us today to schedule your consultation.
